3. How We Engage a Subprocessor
Before a subprocessor begins processing Customer Personal Data we assess whether it can meet the obligations in our Data Processing Agreement, and we put a written contract in place imposing data-protection obligations no less protective than those we owe our customers, including confidentiality, security, breach notification, and restrictions on onward transfer.
Where a subprocessor processes data protected by the GDPR, the UK GDPR, or Swiss law outside those territories, we put an appropriate transfer mechanism in place, as described in section 19 of the Data Processing Agreement.
Trailblaze Data remains responsible to its customers for its subprocessors' performance.
4. Notice of Changes
We give at least 30 days' notice before a new subprocessor begins processing Customer Personal Data. Notice is given by updating this page and by emailing customers who have subscribed to change notifications.
To subscribe, email privacy@trailblazedata.com with the subject line “Subprocessor change notifications” and the account and email address that should receive them. You can unsubscribe the same way.
Removing a subprocessor, or a change that does not involve a new party processing Customer Personal Data, is recorded in section 5 without an advance notice period.
5. Objecting to a Subprocessor
You may object to a new subprocessor on reasonable data-protection grounds within 30 days of our notice, by emailing privacy@trailblazedata.com with your grounds.
We will work with you in good faith to make a change or offer an alternative that avoids the processing you object to. If we cannot do so within a reasonable period, you may terminate the affected Services on written notice and receive a pro-rata refund of fees you have prepaid for the period after termination. That is the full remedy for an unresolved objection, and it is set out in section 15 of the Data Processing Agreement.
